Jefferson County, MO Hardship License Attorneys

Having your license suspended or revoked can drastically affect your ability to lead a normal life, and it could mean getting to and from work, running errands, and general day-to-day travel may be impossible.

In Missouri, the state’s laws are designed to keep everyone safe on the roads. Because of that, the state courts might take your driver’s license if they believe that you pose a danger to others on the road.

The silver lining is that Missouri has a provision that provides you with a way to possibly combat these issues. This comes in the form of a hardship license.

What are Hardship Licenses in Missouri?

Under Missouri law, these are licenses granted to people with suspended, revoked, or withdrawn licenses on grounds of compassion or hardship. Also known as Limited Driving Privileges (LDPs), they are awarded to help with particular situations.

Hardship licenses are limited driving licenses that help you meet your obligations while your normal driver’s license is suspended or revoked. For example, they allow you a means to get to and from work.

However, the state isn’t just going to hand out this type of license to anyone who might need it. After all, there’s a reason a driver’s license is suspended in the first place. Depending on your situation, an application for a Limited Driving Privilege can be sent to either the Missouri State Department of Revenue or a Circuit Court.

It is a complex process and one that an experienced hardship license attorney in Jefferson County, MO, like Grafe & Batchelor can help you with. So, if you’re thinking of applying for this license, you should contact us to help you through it. Call criminal defense attorneys at law today at 636-933-9151 to schedule a free consultation.

Hardship License Conditions

Apart from working through the process itself, there are certain other requirements that the Missouri Department of Revenue or the Circuit Court will ask of you.

These requirements are meant to ensure that you’re deserving of this type of license and you’ll only use the limited driving privileges for the reason you applied, nothing more.

These conditions include:

  • Evidence that you’ve installed an ignition interlock device (IID) that’s approved by the state.
  • Proof that your driving habits are better and pose no risk to other road users.
  • Proof that you haven’t been involved in any alcohol-related cases on the road.

If approved, the limits of these driving privileges will be expressed in the petition. However, because of the strict measures put in place by the state, certain drivers will not qualify for a hardship license. These ineligible drivers may include:

  • Drivers with felony convictions caused when they were driving.
  • Drivers with DWI convictions. Although, they may be eligible for a Restricted Driving Privilege (RDP) instead.
  • Drivers convicted of hit and run accidents.
  • Drivers who haven’t paid all their tickets in Missouri or other states.
  • People not residing in the state of Missouri at the time of the filing.
  • Drivers who haven’t met all the requirements for reinstatement.
  • Drivers whose CDLs have been suspended or revoked.
  • Drivers with unsatisfied motor vehicle judgment.

How Long Does it Take to Get a Hardship License in Missouri?

Once you have your documents in order and have filed the petition, the courts or revenue board will review the application and give you feedback within 5-7 working days.

Once approved, you’ll get a Limited Driving Privilege notice in the mail. Make sure to have that with you whenever you’re in the car.

Also, make sure to comply with all driving laws while on the road. Any traffic infraction or violation will likely result in the immediate revocation of the license.
